The agreement between HOA PH and the HOA organizations and users who subscribe to and use our platform.
The Platform is intended for use by registered Homeowners Associations in the Philippines, their authorized officers, and their residents. By subscribing, you represent that:
You are responsible for maintaining the confidentiality of your login credentials. Sharing of admin credentials is strictly prohibited and may result in account suspension.
HOA PH offers tiered subscription plans (Starter, Professional, Enterprise) billed on a per-property, per-month basis. Plan details, pricing, and included features are described on the Pricing page.
New subscribers may access the platform under a free trial period as specified during registration. No credit card is required during the trial. Full feature access begins upon payment of the first billing cycle.
Payments are processed through PayMongo, our licensed payment gateway partner. Accepted methods include GCash, Maya, credit/debit cards, and bank transfers. Invoices are issued monthly.
Subscriptions unpaid for more than 15 days beyond the due date may result in temporary platform access restriction. Data is preserved for 90 days after subscription lapse before permanent deletion.
Subscription fees are non-refundable once the billing period has commenced. If you experience a platform issue that causes a complete loss of service, contact us within 7 days for review.
You agree not to use the Platform to:
Violation of this section may result in immediate account termination without refund.
HOA PH targets a monthly uptime of 99.5%. Scheduled maintenance windows will be announced at least 24 hours in advance via email and the System Status page.
We are not liable for downtime caused by third-party infrastructure failures, force majeure events, or factors outside our reasonable control (e.g., internet outages, natural disasters).
You retain full ownership of all data entered into the Platform by your HOA — property records, resident information, financial transactions, and documents.
HOA PH acts as a data processor on your behalf. The HOA, as the Personal Information Controller, is responsible for ensuring that the collection and use of resident data complies with RA 10173 and relevant NPC regulations.
Data export is available at any time in CSV format. Upon subscription termination, you may request a full data export within 90 days before permanent deletion.
To the fullest extent permitted by applicable law, HOA PH shall not be held liable for:
Our total cumulative liability shall not exceed the total subscription fees paid by the Subscriber in the three (3) months immediately preceding the claim.
All software, source code, designs, trademarks, and content of the HOA PH Platform are the exclusive intellectual property of HOA PH. No license is granted to copy, reverse-engineer, distribute, or create derivative works from any part of the Platform without prior written consent.
Your HOA's data and uploaded documents remain your property. HOA PH does not claim any ownership over content you upload to the Platform.
You may cancel your subscription at any time by contacting us at hoamsph@gmail.com. Cancellation takes effect at the end of the current billing cycle. No partial refunds are issued.
We may suspend or terminate your account immediately, with or without notice, if:
Upon termination, your data will be retained for 90 days to allow export, after which it will be permanently deleted.
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the appropriate courts of the Philippines.
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 15 days' notice via email to the registered HOA contact. Continued use of the Platform after the effective date of changes constitutes acceptance of the updated Terms.
